Fundraising Terms & Conditions

These Terms and Conditions constitute the agreement (the “Agreement”) between Bauer Media Cash for Kids Charities (registered Charity numbers 1122062, SC041421 and SC003334) (“the Charity”) and the individual generating financial support for the Charity (“the Fundraiser”).

Fundraisers are reminded that funds raised are not their money but the public’s money and that they have a lawful duty to protect it. Fundraisers must be vigilant about security when carrying cash.

These Fundraising Terms & Conditions should be read in conjunction with Bauer Radio Limited’s General Terms and Conditions. On the date on which the Fundraiser ticks the box to confirm they have read these Fundraising Terms and Conditions, they confirm they have read and agreed to be bound by these Fundraising Terms and Conditions and Bauer Radio Limited’s General Terms and Conditions.

These Fundraising Terms & Conditions are in addition to any event/campaign specific Terms & Conditions. In the event of any conflict between these Fundraising Terms & Conditions and the event/campaign specific Terms & Conditions, the event/campaign Terms & Conditions will take precedence.

1. Funds Raised

  1. You agree that you will bank the funds you raise:
    1. via an online fundraising page that you have set up (e.g. Cash for Kids GivingIsEasy, JustGiving or similar);
    2. into the Cash for Kids bank account;
    3. or by sending a cheque to Cash for Kids.
  2. All monies raised must be paid no later than 14 days from the fundraising event or campaign end date.
  3. All money submitted by Fundraisers will be donated to Cash for Kids and is non-refundable.

2. Fundraising Guidelines

  1. Fundraising for Cash for Kids must be in accordance with the Charity’s fundraising guidelines, and it is your responsibility to ensure you fully comply with the following;
  2. All fundraising activities undertaken on behalf of Cash for Kids must be legal. In particular, please ensure you refrain from any undue pressure on individuals to donate, especially if they have told you that they do not wish to make a donation.
  3. Street collections or fundraising on publicly owned land must only be undertaken if the appropriate permission and/or licences have been obtained from the relevant local authority. Any guidance/rules given by the local authority on obtaining such permission must be followed.
  4. Collections or fundraising on privately owned land must only be undertaken if permission has been obtained from the property/landowner. Any guidance/rules given by the property/landowner on obtaining such permission must be followed.
  5. Fundraisers are not permitted to do anything which puts either themselves or anyone else in danger, or which does, or may, damage the reputation of Cash for Kids, Bauer Radio Limited or any associated companies/organisations.
  6. Fundraisers should consider putting in place appropriate insurance for their fundraising activity. Please note that no insurance cover is provided by Bauer Radio Limited or Cash for Kids.
  7. Fundraisers should not leave any promotional literature on vehicle windscreens or trespass on private property.
  8. Fundraisers aged under 18 must be accompanied at all times by someone aged 18 or over.
  9. You must abide at all times with applicable laws, including but without limitation the Charities Act 1992 and all applicable data protection laws.

3. Withdrawal of Support

Cash for Kids reserves the right to withdraw fundraising support at any point with or without cause by sending written notice to the Fundraiser by recorded first class post and it shall be deemed received on the second day after the day of posting. Should this occur, the Fundraiser shall cease to raise funds for the Charity, return any unused materials supplied by the Charity, will no longer be authorised to use the name, logo and/or brand of the Charity, and shall immediately pay to the Charity any sums raised thus far.

4. Website & Systems Terms

Your use of Cash for Kids website(s) and systems is subject to our Terms of Use and Privacy Policy.

Your use of Bauer Media (radio station) website(s) and systems is subject to the Terms of Use and Privacy Policy.

5. Inappropriate Content

Anyone found to have added content deemed inappropriate to a Cash for Kids fundraising page will have their account suspended immediately. Accounts will be reinstated at the discretion of the local Cash for Kids Charity Manager.

6. Restrictions for Lotteries, Raffles and Tombolas

  1. Lotteries, raffles & tombolas are regulated activities governed by the Gambling Act 2005, therefore you must follow these general rules:
    1. All tickets must be sold during one event, or to people at one place of work (multiple buildings at one site are ok but multiple sites are not);
    2. No more than £500 of the proceeds can be used to purchase prizes;
    3. No more than £100 of the proceeds can be used to cover operational costs (e.g. printing tickets);
    4. Tickets must be sold at the event/on the premises. You can’t sell tickets online (which includes social media) or in advance of the event.
    5. There must be no rollovers.

7. Fundraising Health & Safety

  1. If your fundraising involves you taking part in a physical activity this may expose you to the risk of personal injury and it is your responsibility to ensure that you are fit enough to take part.
  2. To minimise the risk of causing harm to yourself, we ask that you:
    1. take care to ensure that, to the best of your knowledge, you are fit to participate in the activity;
    2. refrain from taking part if you are suffering from any disease or medical condition which may prevent you from safely taking part or which may be aggravated if you do take part;
    3. refrain from taking part if you feel unwell/are in pain during the activity;
    4. seek suitable medical advice prior to starting the activity and refrain from taking part if you are advised not to.
  3. The Charity accept no liability for your health, safety or any injuries while fundraising for us. We encourage you to be sensible and take all safety precautions.
  4. If completing physical activity (such as running, jogging, cycling) alone, Fundraisers should be mindful of their own personal safety and take necessary precautions to protect their safety. Consideration should be given to:
    1. Completing the activity with another person;
    2. Notifying friends/family that you are completing the activity and informing them of the route you are planning to take;
    3. Wearing a tracking device or ensuring tracking apps are enabled on devices that you will be carrying whilst you are completing the activity (e.g. “Find Your Friends” on an iPhone);
    4. Ensuring that any headphones that you are wearing are at a volume level that still enables you to hear what is happening around you;
    5. Using well-lit routes and not using routes that are quiet, dark and out of sight of a main road.

8. Do’s and Don’ts

  1. Do keep in mind that we are a children’s Charity when planning ways to fundraise, so try and stay away from events/activities with adult themes. Please call us for clarification if unsure.
  2. We are happy for you to use the Cash for Kids logo in any promotional materials to support your fundraising (including online and on social media). Please contact us to get hold of copies of our logo and for guidance on its usage. All materials featuring our logo must be submitted to Cash for Kids for approval before being published.
  3. You must state in all correspondence and on all notices, advertisements and other documents soliciting funds for the Charity that the Charity is a registered Charity and provide the Charity’s registered Charity number.
  4. Do encourage anyone who is a UK taxpayer and donates to your fundraising to include Gift Aid, as this will benefit the Charity with no additional cost to you or your supporters. We can claim 25p from HMRC for every £1 donated. Please note that Gift Aid cannot be claimed where the donor is entering a competition or is receiving anything of financial value in return for their donation.

9. Use of Personal Data

  1. Fundraisers names, email addresses, addresses and telephone numbers may be collected and used for purposes in connection with your fundraising. Your details may remain stored after your fundraising has been completed but will not be used for marketing purposes unless you have ticked an opt-in box. If you have, your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. For more details, see our Privacy Policy.
  2. By fundraising for the Charity you are consenting to the use of any materials produced by you in relation to your fundraising (and have obtained all necessary third party consent from anyone appearing in, or involved in, producing such materials) to publicise your fundraising. This means that we may use all names, images, descriptions, photographs, video footage, and other information, which you’ve submitted in any media in relation to your fundraising, without paying you and without any time restriction.
  3. You also agree that we may film, record or photograph you in connection with your fundraising. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also (and will have obtained consent from anyone appearing in, or who has been involved in producing materials related to your fundraising) have waived any moral rights or right to payment that you may have had.

10. General

  1. You may not transfer, assign, charge or otherwise dispose of any of your rights or obligations arising under these Terms.
  2. A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any term of them against the Charity. However, the Charity is permitted to enforce these terms against all fundraising participants, including anyone entered as part of a group or family entry.
  3. If any of these Terms or any part thereof are unenforceable, the enforceability of all other terms and conditions shall not be affected.
  4. No failure by us to exercise any right or remedy under these Terms shall operate as a waiver of that right or remedy and no waiver by us of any breach of these Terms shall operate as a waiver of any subsequent breach.
  5. You will indemnify and keep us indemnified against any damage, loss, liability or cost incurred by us resulting from any breach of these Terms by you.
  6. These Terms shall be governed and construed according to English law and the English courts shall have exclusive jurisdiction regarding any claim or matter arising under these Terms.
